Hello all,
I am a student on an I20/M1 vis
I have just recieved a new I20, and sent a form I 539 for extension of my I20.
I have my old I94, I20 etc.
It is currently under processing.
First, is there any way they can move it to another processing center? Its in the vermont center right now, and they are still processing documents from May 2008 according to CIS website.
Second, my original I94 is valid till 14 April 2009 but my original I20 is expired.
My visa is 5 years(M1 valid to 2013)
Can I go and visit my home country with the old I94(since its valid long enough) and new I20(which just got issued)??
or do I need to wait until the processing comes through?

I have a question on the receipt number. If we get the receipt number, does it mean "The application is accepted" (All the supporting documentation and fee are coorect)?

The cut-off date for an oversubscribed category is the priority date of the first applicant who could not be reached within the numerical limits. Only applicants who have a priority date earlier than the cut-off date may be allotted a number.
They stress and bolded "Earlier Than" so i am not IN???? :confused::confused::(:(

Can someone work in US on H1B and in India for an Inidan company and get paid in Inidan currency? If H1B restricts you from doing so I am willing to switch to EAD if that permits me from working remotely for indian company.
that's how infy, wipro, tcs work...they get ppl here on H1 and get paid in dollars....once they go back to india, they get paid in rupees....u need h1 if ur in the US.

My wife is a Canadian citizen, what is the process of getting a H4 for her? (I am on an H1-140 approved).
1)Do I file an app with USCIS?
2)Can she go apply at the US consulate in Canada?
What type of documents, forms are involved ?
The reason for this post is I was given conflicting info by my old lawyer.

If a College fresh guy gets Rs 6,00,000 / yr at bangalore what will be the salary of a 10yr experienced developer 5 years down the line when the talents will move back ?
In fact I�m sure 10yr experienced can immediately mandate a salary of Rs 30,00,000 /yr at Bgl �. You will save almost the same that you are saving here.

Following is the situation:
My H1 (6 years) expiring on 7th Mar'08 (have 35 days of vacation might be good till 11th Apr'08)
Labour filed on 06/20/2007 , still awaiting..(so 365 days rule does not apply for 7th yr ext)
Spouse was on H4, got H1 in Oct'2007 (no stamping done for H1).
Falling short of 10 weeks to get the 365 days rule
Options that I learnt for me getting 7th yr extension and staying in the country:
Option1:
Convert to H4 toward the end of H1 6 yrs expiry date till June 20th(to get the 365 days rule in effect)
File for 7th year extension based on the 365 days rule
Convert from H4 to H1 and start working.
Option 2:
Get Canada working visa (not sure how long it will take to get though) and work till June 20th there (to get the 365 days rule in effect)
File for 7th year extension based on the 365 days rule
Stamping in canada to return to USA.
(I am hoping 7th year extension can be done while I am outside the country)
Option 3:
Go back to India for 3 months wait till June 20th,
File for 7th year extension based on the 365 days rule
Stamping in India to return to USA.
(I am hoping 7th year extension can be done while I am outside the country)
Option 4:
Leave for India immediately and stay there for 10 weeks and recapture them along with 7th year extension(while I am in India )

I e-Filed the AP for my wife and myself over a month ago. We received the receipt notice for my application but did not receive it for my wife's application. The e-filing generated the receipt number starting with LINxxxxxxxx for both the applications that shows as valid application at the USCIS's online status tracker. Should I contact the USCIS's customer service and inquire about the receipt notice for my wife's application of just ignore it coz' its not a big deal as we already have the receipt numbers?

You could try to reopen the case with Supporting evidence of ill health and age. This is a long shot, but a good attroney should be able to pose a compelling argument. Also, try to get an infopass appointment and talk to someone about your options.

Not true! In the above scenario you will only be permitted to extend your H1 in yearly increment. To get a three-year extension you must have an approved I-140 Immigrant Petition for an Alien Worker.

Check with your international students office. In our time, they needed to sign the I-20 before you/your wife can leave the country. I also think she needs a separate I-20 with a F2 endorsement. She should not just carry your I-20 with her name in it, then you are supposed travel with her. Again, these were the old rules and I am not an attorney and this is not a legal advise, just from my personal experience.
