1st time prevailing wage was OK (lower than the salary). This time during extension, prevailing wage is more that the salary, though salary increases over the time. So employer is telling they r not able to renew H1B, because it is hard to increase the salary due to the inequity among employers. What is the solution? Thanks

Hi all:

I entered the country on Advance Parole and so now I am on EAD status because of that.

I am on my 8th year of extension. My H1B was valid till 2009 but now it is not because of my EAD. Its been more than a year since I applied for 485 and My I-140 has been approved.

Q.1 Can I join another employer based on a new H1B so as to reinstate my H1B status? I plan to file for AC21 if I change employers.

Q.2 Can I apply for a new H1B with my CURRENT employer based on my current job?

I would really appreciate your input.

Are you in consulting business. Technically you are supposed to work at the location where you have filed your LC. If you had filed prior to PERM, then you may be fortunate because pre-PREM there was a textarea where the employer could explain about where the beneficary would work. Consulting firms filled out this column in such a way that you could work anywhere in US, but your head office is xxxx. If this is the case then you should not have problems other than filling our AR-11 and sending it to DHS / USCIS.

If it is after PERM, then you do not have any options. I am not sure how consuting firms handle this situation.

We did the exact same thing. We informed officer that my wife's Extension is pending, he said that's fine and gave her I-94 valid for 40 days (time remaining on her H4 visa).

After she get her I-94 for 40 days then if her new H4 application is approved then she will get the extension of her I-94.

Yes, If you have enough Money, Usally 8,000-10,000 $ in the bank statement( This is checked for covering any Medical Bills etc when they are here, just to make sure that the sponser is able to take care of all these when they are in US), That would be enough for you to sponser them.

My attorney havent received it back as rejected yet.

Called USCIS to Expediate the process: 04/29/2008
Biometrics & I-765 Received through Mail: 05/05/2008
Fingerprinting complete (Walk-In): 05/07/2008 (Actual Fingerprinting date from the notice: 05/22/2008)
Fingerprinting Location: Alexandria, VA
Called USCIS to Expediate the process: 05/08/2008 (No status change until 05/13/2008) [2nd time)
Called USCIS to Check the status: 05/13/2008 (3rd time)
Card Production Ordered: 05/13/2008.
Approval Notice Status change online: 05/16/2008

My 1 cents, please call USCIS every 2 days otherwise your case will be in the queue as "Pending and case received".
